This is fresh from the Courts this morning.
Anwar Ibrahim is suing former Deputy President of Parti Keadilan Rakyat Dr Chandra Muzaffar for RM10.0 million for somethings that Dr Chandra had said about Anwar. The three things that were part of Anwar's suit against Dr Chandra were :
i. for saying that it would be an unmitigated disaster for Malaysia if Anwar became the Prime Minister
ii. for saying that Anwar was deceiving the people
iii. for saying that Anwar had threatened a Hindu temple in Penang (in March 1998) that the "temple's bells would stop ringing"
Well everyone
turned up in Court this morning except Anwar of course. In a dramatic
turn of events, Anwar's lawyers applied to the Court that they wished to
withdraw (yes folks withdraw) TWO out of three charges against Dr Chandra Muzaffar.
They applied to the Court and the Court also granted their request that i. and ii. above :
i. it would be an unmitigated disaster for Malaysia if Anwar became the Prime Minister
ii. that Anwar was deceiving the people
would be dropped from their libel suit against Dr Chandra.
This means that
Anwar will not object anymore (thru libel suits in Court) if people say
that it would be an unmitigated disaster if he became Prime Minister
and that he has been deceiving the people.
But there is
another way of looking at this. If he had kept his mouth shut and not
said anything about Dr Chandra's statements (or if he had not made that
Police report against the 50 Dalil book in 1998, or if he had kept quiet
and NOT made that Police report against that China Doll video, or if he
had kept quiet and NOT sued Nallakaruppan for slander) it would have
avoided him tons of trouble.
But its too late now. It is a different scenario. First he sued Dr Chandra, and then he is withdrawing two out of three points of his contention. To the ordinary man it comes across that since Anwar has withdrawn
these two charges, it means he is agreeing that yes it will be an
unmitigated disaster if he became Prime Minister and yes that he has
been deceiving people.
Daripada dulu
sampai sekarang, Anwar Ibrahim's single biggest problem is that he
cannot think very logically. His actions have always been knee jerk and
stop gap actions. Has anyone figured out
why he ran to the Turkish Assembly after he heard that Saiful had lodged
a Police report against him for sodomy?
If any of you
think he knows anything about the economy then just ask him : will you
abandon the entire New Economic Policy? Just answer yes or no. Let me
tell you folks - his answer will be no. He will not abandon the New
Economic Policy. Habis apa program dia yang lebih bagus atau yang lagi
beza? The brader has got no ideas. Lights are on in the factory but the
machinery is not working.
He has dropped
these two charges against Dr Chandra because he did not think when he
first filed the suit. Saying that he is an unmitigated disaster and
that he is deceptive is not libelous. It would not have stood up in
Court. It is an individual passing a judgement on someone who wants to
be the PM. What is wrong with that?
I mean dont the
Pakatan dunggus say (everyday without fail) that the PM Najib is
deceiving people and that it is an unmitigated disaster for Malaysia if
Najib remains the PM? You guys say it everyday. Apa nak sue libel lah,
sue slander lah, sue ini lah, sue itulah. So should Najib sue you when
you say the same things against him?
Stop being childish and stupid and stop suing people in Court for every single thing they say.
My view is that Anwar Ibrahim is as dumb as they come. He barely graduated with a weak degree in Malay Studies. That was the place you went to if you could not get into the other faculties in University Malaya. Instead
of talking about Malay studies he started talking about religion. Then
he took over ABIM - Angkatan Belia Islam Malaysia. Until today we can
see the disastrous impact of the ABIM influence in Malaysia.
Yes it will be an unmitigated disaster if someone with such poor talent became the PM of the country. - OUTSYED THE BOX

ReplyDeleteBekas rakan karib Anwar itu berkata beliau sanggup disaman walaupun RM500 juta kerana mendakwa mempunyai bukti yang boleh menyokong kenyataannya dan bersedia mendedahkannya di mahkamah.

ReplyDeleteBEKAS Penolong Gabenor Bank Negara Malaysia (BNM), Datuk Abdul Murad Khalid, mendedahkan bahawa Datuk Seri Anwar Ibrahim pernah mengawal sebanyak 20 Akaun Induk (Master Accounts) yang diuruskan oleh kroni-kroninya membabitkan aset, saham dan wang bernilai lebih RM3 bilion.

ReplyDeleteAbdul Murad dalam Akuan Berkanun yang diikrarkan di depan Pesuruhjaya Sumpah di sini pada 26 Oktober 2011 lalu mendakwa Anwar menggunakan wang akaun induk itu untuk memajukan cita-cita politiknya termasuk membayar hutang-hutang para penyokong. Sebahagian daripada mereka yang mendapat bantuan Anwar sekarang merupakan aktivis parti pembangkang.

ReplyDeleteBeliau juga mendakwa bekas Timbalan Perdana Menteri itu memperalatkan pengaruh BNM untuk keuntungan perniagaan kawan-kawan, kroni dan elemen-elemen asing. Menurut beliau, Anwar memberikan sekurang-kurangnya AS$10 juta (RM38 juta) kepada sebuah agensi kumpulan pemikir Amerika Syarikat yang berpusat di Washington untuk menaikkan imejnya di negara-negara Barat, khususnya di Amerika Syarikat, United Kingdom dan lain-lain negara Eropah.

ReplyDeleteAbdul Murad, 46, membacakan Akuan Berkanun beliau itu pada sidang akhbar yang diadakan di Hotel Grand Olimpic pada Oktober 2011. Dalam nada kesal beliau mengakui bahawa beliau juga ialah salah seorang kroni yang menguruskan akaun induk milik Anwar.

ReplyDeleteBagaimanapun, beliau mendakwa terpaksa melaksanakan arahan-arahan Anwar seperti mengatur pinjaman-pinjaman bank dalam jumlah beratus-ratus juta ringgit untuk kroni-kroni lain walaupun ini bertentangan dengan undang-undang ''kerana sebagai Menteri Kewangan dia akan cincang saya jika arahan-arahan tersebut tidak dilaksanakan.''

ReplyDeleteBeliau juga mengaku memperkenalkan seorang lelaki Cina bernama Tong Kooi Ong juga terlibat dalam memberi bantuan kewangan kepada Anwar. Tong ialah Ketua Pegawai Eksekutif (CEO) Phileo Allied Berhad, sebuah syarikat yang tersenarai di papan utama BSKL. Phileo Allied Bank berada di bawah kawalan Tong.

Shamsidar ialah isteri kepada Azmin Ali, bekas Setiausaha Sulit kepada Anwar. Kata Abdul Murad: ''Adalah diketahui dengan meluas bahawa Shamsidar dibayar gaji yang tinggi dan disediakan dengan sebuah kereta dan pemandu dan pada kebanyakan masa dia tidak perlu pergi bekerja.''

ReplyDeleteAbdul Murad juga mendedahkan beberapa urus niaga lain yang melibatkan arahan Anwar, antaranya mengatur pinjaman-pinjaman bank untuk kawan-kawan bekas Timbalan Perdana Menteri itu.
Individu-individu yang terlibat ialah:
* Menyelesaikan hutang Tan Sri Abdullah Ahmad (Duta Khas Malaysia ke Pertubuhan Bangsa-Bangsa Bersatu) sebanyak RM10 juta dengan Bank Bumiputra. Beliau membantu merundingkan jumlah penyelesaian sebanyak RM7 juta. Sejumlah RM5 juta diambil daripada Akuan Induk untuk membayar hutang itu. Bakinya RM2 juta diperoleh daripada Abdullah yang mendapat wang daripada penjualan tanahnya.
Delete* Anwar mengarahkan beliau membantu menyelesaikan hutang Marina Yusof dengan bank-bank tempatan yang berjumlah lebih daripada RM20 juta. Abdul Murad menyerahkan permohonan itu kepada Tabung Pemulihan Usahawan (TPU) untuk bantuan membangunkan sebidang tanah di Jalan Tun Razak, yang sekarang merupakan Kompleks Marinara yang telah siap. Dalam kes itu beliau berkata, panel TPU meluluskan permohonannya. Marina Yusof benar-benar terhutang budi kepada Anwar.
Delete* Sebuah syarikat yang berpangkalan di Pulau Pinang, Mercury Securities berhutang dengan MUI Bank lebih RM10 juta yang diperoleh melalui cagaran tanah pihak ketiga. Pemegang saham majoriti ialah Chew Seng Guan dan seorang bernama Ahmad Kamal yang dididik oleh Anwar untuk menjadi bakal ahli perniagaan bumiputera dan ahli politik.
Delete* Anwar mengarahkan Abdul Murad membantu kumpulan bekas Ketua Pengarang Berita Harian, Datuk Nazri Abdullah untuk mengambil alih Kumpulan New Straits Times daripada Renong. ''Saya mendapatkan Kumpulan Hong Leong untuk menstrukturkan urus niaga itu. Saya bercakap dengan Seow Lun Hoo dan Quek Leng Chan dari Hong Leong. Mereka mencadangkan supaya kumpulan Datuk Nazri menggunakan MRCB sebagai saluran untuk mengambil alih saham New Straits Times. ''Saya kemudian bercakap dengan Maybank untuk mengatur pinjaman kepada Nazri bagi membeli MRCB dan satu lagi pinjaman untuk membeli NST.''
Delete* Beliau juga telah diarahkan oleh Anwar untuk membantu Faiz Abdullah, seorang penulis teks ucapan Anwar yang juga salah seorang peguam bekas Timbalan Perdana Menteri itu, untuk mendapatkan pinjaman bank berjumlah lebih RM400 juta untuk membeli Kewangan Usaha Bersatu Berhad (KUBB). ''Pada masa itu KUBB dimiliki oleh Idris Hydraulic Berhad. Skim itu melibatkan penggunaan Arus Murni Berhad yang sebelum itu dikenali sebagai Timuran Berhad, sebuah syarikat yang disenaraikan di papan utama BSKL sebagai syarikat pemegang. ''Saya menemui bank-bank berikut untuk membantu mendapatkan pinjaman untuk membeli saham KUBB bernilai lebih RM400 juta: 1. Hong Leong Bank, 2. Hong Leong Finance, 3. Sime Bank, 4. RHB Bank, 5. Southern Bank, 6. BSN Commercial Bank,'' katanya.

ReplyDeleteNoh, who is also Agriculture and Agro-based Industry Minister, said it was public knowledge that in 1996, DAP chairman Karpal Singh said in Parliament that he had evidence of Anwar's involvement in a sodomy case and that the party may reveal it should Anwar become prime minister.

ReplyDeleteNoh was asked to comment on a front-page report in Mingguan Malaysia today which reported that PAS'Syura Council (highest decision making body in PAS) had rejected Datuk Seri Anwar Ibrahim for the post should the opposition win the GE.
However, the report said that although the council's stand on the matter could not be verified, it was allegedly made during a closed-door discussion involving several council members recently.
ReplyDeleteJust World president Chandra Muzaffar has asked opposition leader Anwar Ibrahim whether he (Anwar) is now admitting that he will be an "unmitigated disaster" should the opposition win the forthcoming general election and Anwar becomes the prime minister.
ReplyDeleteChandra, a former PKR deputy president, also asked whether by removing two paragraphs from the RM10 million defamation suit Anwar filed against him - that the Kuala Lumpur High Court allowed today - also meant that Anwar was admitting he did deceive the public.
Justice Nik Hasmat Nik Mohamad allowed Anwar to amend his statement of claim and ordered the politician to pay RM1,000 as costs.
Firoz Hussein Ahmad Jamaluddin (right in photo), who acted for for Chandra, said the court allowed Anwar to amend his statement of claim and that this was quite significant because Anwar withdrew two allegations that had been included in his suit.
Anwar was therefore narrowing the scope of his suit, Firoz Hussein said. Outside the court, Chandra referred to two paragraphs that Anwar took out of his statement of claim.
The two statements were reported by The Star and New Straits Times in 2008, resulting in Anwar suing Chandra for defamation.
"If Datuk Seri Anwar Ibrahim (left) becomes Prime Minister, it will be an 'unmitigated disaster' for Malaysia, a former Parti Keadilan Nasional (before they joined forces with Parti Rakyat Malaysia to become PKR) deputy president said at a forum yesterday." This paragraph was carried in The Star .
The NST reported: "Asked why he was breaking his silence now, Chandra said it appeared the people were being deceived by Anwar, and this was something which he was prepared to do."
Chandra said: "This is something that Anwar has to answer, emanating from this action of the removal of the two paragraphs.
"Is Anwar now admitting that he would be an 'unmitigated disaster' should the opposition win and is he now admitting that he had deceived the public?"'Anwar acted for freedom of speech'
Counsel N Surendran and Latheefa Koya, who acted for Anwar, told reporters outside court that Anwar moved to remove the two paragraphs after taking freedom of speech into account.
Chandra was entitled to his opinion, Surendran said, and he went on to note that the court also ordered Chandra to justify his defamatory statement in the two newspaper reports, in reference to the Kampung Jawa clash in Penang, on which he quotes Anwar as saying that he (Anwar) would make sure the temple bells would not ring anymore.
Latheefa also confirmed that Anwar was asked to pay costs of RM1,000 for his application to amend his statement of claim.
ReplyDeleteJustice Nik Hasmat has ordered the case to go for trial on April 3 and 4. The two parties had met in court in April last year, but they failed to reach an out-of-court settlement.
On March 6, 2008, Anwar sued Chandra for making defamatory remarks about him at a forum held at Menara Star in Petaling Jaya on March 3, 2008, which were subsequently published in newspapers.
Anwar claimed that Chandra used the offending words to disparage him in both his private and official capacities, including as former deputy prime minister and former finance minister, and claimed that the defamatory comments, among others, meant that he promoted and incited racial hatred among the races in Malaysia.
Chandra, in his statement of defence filed on May 16, 2008, denied having uttered malicious, false or defamatory comments about Anwar, which the opposition leader claimed were published in two local English newspapers on March 5, 2008.
Alternatively, Chandra claimed that if the words were defamatory, which he denied, then they were published on an occasion of qualified privilege and without malice.
'A bid to distract attention'
Surendran, in commenting on Chandra's assertion, described the Just World president as mischievous, false, absurd and making a futile attempt to distract attention from the heart of the matter.
"The High Court judge in allowing Anwar's application to amend the statement of claim did not make any ruling that the amendment would amount to an admission. Chandra's statement is based on his own baseless and illogical interpretation of the court order. In fact, the judge agreed with Anwar's lawyers that the amendment would help narrow down issues at the trial.
"Chandra is blowing hot and cold, because he had through his lawyers objected to Anwar's amendments. Chandra's objections were rightly rejected by the judge this morning. If Anwar's amendments meant that he is admitting to being a 'disastrous PM', why then did Chandra object to the amendments? Chandra appears now to be lashing out, after having lost the argument in court this morning," said Surendran in a statement.
Surendran explained that Anwar is suing Chandra for making a false and libelous statement alleging that Anwar had said that he would make sure 'temple bells would not ring any more'.
"Chandra must answer for this outrageous statement in court. Chandra's statement today is thus a futile and desperate attempt to distract attention from the real issue in the lawsuit.
"In any event, whether Anwar should be PM is a decision for people of this country to make at the 13th general election. It is not for any court of law to make this decision. Chandra must learn that this is how a real democracy functions," said Surendran.
